6 States Block Title IX Revisions Enforced by Biden-Harris Administration
As many as 26 states have successfully blocked the Title IX revisions implemented by the Biden-Harris administration, with hundreds of colleges potentially following suit. According to The Center Square, these states have obtained an injunction preventing nearly 700 schools from enforcing the new rules if their students are affiliated with organizations like Young America’s Foundation or Female Athletes United, both of which are plaintiffs in the case.
The revisions, which took effect on August 1, permit individuals who identify as female to access female-designated spaces such as bathrooms and locker rooms.
The states involved in the lawsuit include Alabama, Florida, Georgia, South Carolina, Alaska, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Montana, Ohio, Tennessee, Texas, Utah, Virginia, West Virginia, Wyoming, Arkansas, Missouri, Iowa, Nebraska, North Dakota, and South Dakota. A Kansas judge issued the injunction blocking the Title IX changes at any American school with students from the suing groups. Inside Higher Ed reported that this ruling affects 48 states in total, with the Supreme Court upholding the decision.
Spencer Brown, Chief Communications Officer for Young America’s Foundation, stated in an email to The Center Square that the injunction halts the Department of Education from enforcing what he describes as “novel, illogical rules that jeopardize both free speech and personal safety.”
Brown emphasized, “Students can now express their views knowing the law supports them. YAF remains committed to challenging these rules until a final decision eliminates the Biden-Harris administration’s damaging policies. YAF activists are at the forefront of critical campus debates, including issues of transgenderism and women’s safety. This lawsuit is our way of defending every student’s right to express their beliefs, and our membership continues to grow in response.”
