**Wisconsin Supreme Court Declines to Hear Democrat AG’s Lawsuit Aimed at Blocking Elon Musk’s $1M Payments**

 **Wisconsin Supreme Court Declines to Hear AG Josh Kaul’s Lawsuit Against Elon Musk’s $1M Giveaway** 



 

The Wisconsin Supreme Court has rejected a lawsuit filed by state Attorney General Josh Kaul (D) aimed at preventing Elon Musk from awarding $1 million to two attendees at his town hall event on Sunday evening.  

In a Friday filing, Kaul sought emergency relief to stop Musk and his America PAC from promoting what he called a “million-dollar giveaway” at the event. However, Judge W. Andrew Voigt declined to hear the lawsuit before Musk’s rally, according to *ABC News*.  

The state Supreme Court’s decision follows an appeals court ruling that also denied Kaul’s emergency motion to halt the giveaway. After Judge Voigt’s refusal, Kaul escalated the case to the Court of Appeals, which also rejected his request. He then petitioned the Wisconsin Supreme Court for intervention, but his appeal was denied on Sunday.  

During the event, Musk announced that he would be giving $1 million checks to two individuals who signed a petition opposing “activist judges.” He emphasized that judges should be focused on interpreting the law rather than shaping it.  

**“We have this petition … against activist judges because judges should be simply interpreting the law, not making the law,”** Musk stated. **“We’re seeing some crazy stuff in D.C. where any federal judge can stop any action by the President of the United States. This is insane … this has got to stop at both the federal and state levels.”**  

In addition to declining to hear Kaul’s lawsuit, the Wisconsin Supreme Court also rejected a request from Musk’s legal team to have Justices Rebecca Frank Dallet and Jill J. Karofsky recuse themselves from the case. Musk’s lawyers argued that both justices had actively campaigned for liberal candidate Susan Crawford, who has been critical of Musk.  

With the Wisconsin Supreme Court election looming, the race between Waukesha County Circuit Court Judge Brad Schimel and Crawford is considered one of the most consequential contests of 2025. Schimel, a former state attorney general, has warned that the court’s liberal majority is pursuing a political agenda rather than applying the law impartially.  

**“Two years ago, the liberals took over our Wisconsin Supreme Court,”** Schimel said in an interview with *Breitbart News Saturday*. **“Since they got the majority, they have been striking down all the laws they don’t agree with, checking off a wishlist of political priorities.”**
